These Terms of Service (the “Terms”) constitute a legally binding agreement between you (“you”, “your”, or the “Customer”) and La Caviare (“La Caviare”, “we”, “us”, or “our”) governing your access to and use of our website, products, and services (collectively, the “Services”).

By accessing the Services or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must refrain from using the Services.

1. Eligibility and Use of Services

You represent and warrant that you are of legal age in your jurisdiction and have the legal capacity to enter into this agreement.

You agree to use the Services solely for lawful purposes and in compliance with all applicable laws and regulations. Any misuse of the Services, including unauthorised access, interference, or fraudulent activity, is strictly prohibited.

We reserve the right, without notice, to suspend or terminate access to the Services where we reasonably believe these Terms have been violated.

2. Products and Availability

All products offered through the Services are subject to availability and may be modified or discontinued at any time without prior notice.

Descriptions, images, and specifications are provided for informational purposes only. Due to the artisanal and perishable nature of our products, variations may occur and do not constitute defects.

3. Orders and Acceptance

By placing an order, you submit an offer to purchase products subject to these Terms. All orders are subject to acceptance by La Caviare.

We reserve the right to refuse, cancel, or limit any order, including in cases of pricing errors, stock limitations, delivery constraints, suspected fraud, or violation of these Terms. If payment has been processed, any cancelled order will be refunded in accordance with applicable law.

4. Pricing and Payment

Prices are displayed in the currency indicated at checkout and may be subject to applicable taxes, duties, and shipping fees.

Payment must be received in full prior to shipment. Payments are processed by third-party payment providers. La Caviare does not store full payment card details.

5. Shipping and Delivery

Delivery dates and times are estimates only and are not guaranteed.

Risk of loss and title to products pass to you upon delivery to the carrier, except where otherwise required by applicable consumer protection laws.

You are responsible for providing accurate delivery information and ensuring timely receipt of perishable goods.

6. Returns and Refunds

Due to the perishable nature of our products, all sales are final once an order has been shipped.

In accordance with applicable Canadian consumer protection legislation and European Union consumer law exemptions, the right of withdrawal does not apply to goods that are liable to deteriorate or expire rapidly.

Claims relating to damaged, defective, spoiled, or incorrect products must be submitted within 24 hours of delivery, in accordance with our Returns & Refunds Policy.

7. Intellectual Property

All content made available through the Services, including text, images, graphics, trademarks, logos, and designs, is the exclusive property of La Caviare or its licensors and is protected by applicable intellectual property laws.

No rights are granted to you other than those expressly set out in these Terms.

8. Third-Party Services

The Services may include links to or integrations with third-party services. La Caviare is not responsible for the content, security, or practices of such third parties.

Your use of third-party services is governed by their respective terms and policies.

9. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services and products are provided “as is” and “as available.”

La Caviare disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are prohibited by law.

10. Limitation of Liability

To the fullest extent permitted by law, La Caviare shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the Services or products.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless La Caviare from any claims, liabilities, damages, losses, or expenses arising from your breach of these Terms or misuse of the Services.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Québec and the applicable federal laws of Canada, without regard to conflict of law principles.

13. Amendments

La Caviare may amend these Terms at any time. Updated Terms will be posted on the website with a revised “Last updated” date. Continued use of the Services constitutes acceptance of the amended Terms.
